Terms of Use

point.game is a platform that helps connect recreational sports players. Our mission is to put you - the players - first, and these terms attempt to do that. We know that most people skim through terms of use because they're boring, but we have done everything we can to make this easy to get through. Above every section, we'll summarize the most important parts, but these summaries are not legally binding, so please look at the full version of the text for a complete understanding of these terms.

Your Account

To summarize: You must be at least 13 years old to use point.game. You are responsible for your account.

When you create an account, you must provide us with accurate information, in good faith, and you agree to keep your information updated if it changes. To create an account or otherwise use point.game, you must be at least 13 years old and you must also be old enough to consent to the processing of your personal data in your country (in some countries we may allow your parent or guardian to do so on your behalf). Please contact us immediately if you believe your account is compromised. You can learn more about security in our Security Policy.

Being an Organizer

To summarize: An organizer is someone who creates a recreational game, or creates and administers a recreational league on point.game ("Platform").

Restrictions

We don't allow games or leagues that violate our terms or policies. A high level summary of those rules is that we don't allow:

  • illegal games or leagues;
  • games or leagues that are abusive towards other people;
  • games or leagues that are misleading or deceptive;

We are constantly experimenting with product features to make point.game better and may add, remove, or test features with a subset of users/organizers. Access to these features is not guaranteed and may not be subject to your control. Instead, we may enable and disable these early-access, beta, or test features at our sole discretion. These features may also be subject to additional restrictions and limitations, including some that we describe in our Help Center.

Being a Player or Attendee

To summarize: A player or attendee is someone who joins an existing recreational game or league on point.game, which provides positive interaction with likeminded athletes. Through a game or league on point.game, players/attendees may receive training and directly interact with organizers using tools supplied by us, and, through point.game, have the opportunity to engage with a community of athletes.

To become a player or attendee, simply join a game or league on point.game.

We are constantly experimenting with product features to make point.game better and may add, remove, or test features with a subset of organizers. Access to these features is not guaranteed and may not be subject to your control. Instead, we may enable and disable these early-access, beta, or test features at our sole discretion. These features may also be subject to additional restrictions and limitations, including some that we describe in our Help Center.

Release

To summarize: To the full extent permitted by applicable law, you agree not to hold us responsible for anything that happens related to transactions with third parties, player/attendee interactions, or in connection with a game or league posted on point.game. You also agree not to hold attendees or organizers responsible for their negligence in connection with their Content, or a game or league posted on point.game.

To the full extent permitted by applicable law, you agree to release us and our officers, directors, shareholders, agents, employees, consultants, corporate parent, affiliates, subsidiaries, sponsors, and other third-party partners ( "point.game Parties”) from claims, demands, and damages (direct and consequential) (“Claims”), arising out of or in any way connected with any transaction with a third party, your interactions with other attendees, or in connection with a point.game camp or event. You also agree, to the full extent permitted by applicable law, to release organizers from Claims based on an organizer's negligence arising out of or in any way connected with their Content, a game or league posted on point.game. The law in some countries and states do not allow the release, so these limits may not apply to you. You waive and relinquish all rights and benefits that you have or may have under Section 1542 of the California Civil Code or any similar provision of statutory or non-statutory law of any other jurisdiction to the fullest extent permitted by law.

You acknowledge that some games or leagues posted on point.game carry inherent dangers, such as the risk of illness, bodily injury, disability, or death. By participating in these events, you understand and agree that you have freely chosen to assume these risks.

Indemnification

To summarize: To the full extent permitted by applicable law, you agree to reimburse us if we get sued in connection with your use of our Platform.

To the full extent permitted by applicable law, you agree to indemnify, defend and hold all point.game Parties harmless from any Claims, made by any third party due to or arising out of (a) your violations of this Agreement, (b) your use, misuse, or abuse of our Platform, (c) your Content, (d) your violation of any law, statute, ordinance or regulation or the rights of a third party, or (e) your participation or conduct in a point.game camp or event that violates this Agreement. You agree to promptly notify us of any third party Claims, cooperate with all point.game Parties in defending such Claims, and pay all fees, costs and expenses associated with defending such Claims (including, but not limited to, attorneys' fees). You agree not to settle any Claim without our prior written consent.

Warranty Disclaimer and Limitation of Liability

To summarize: Our Platform is provided to you “as is” and we make no warranties of any kind with respect to our Platform. Our liability in connection with the Platform is limited to the fees you paid to us in the 12 months preceding the claim or $100, whichever is greater.

Warranty Disclaimer. Our Platform is provided to you “as is” and on an “as available” basis. To the full extent permitted by applicable law, we disclaim all warranties and conditions of any kind, including but not limited to statutory warranties, and the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We also disclaim any warranties regarding (a) the reliability, timeliness, accuracy, and performance of our Platform, (b) any information, advice, services, or goods obtained through or advertised on our Platform or by us, as well as for any information or advice received through any links to other websites or resources provided through our Platform, (c) the results that may be obtained from the Platform, and (d) the correction of any errors in the Platform, (e) any material or data obtained through the use of our Platform, and (f) dealings with or as the result of the presence of marketing partners or other third parties on or located through our Platform. You may have additional rights under the law of the country in which you are based. You agree that the duration of such additional rights will be limited to the full extent permitted by such law.

Limitation of Liability. To the full extent permitted by applicable law, you agree that in no event shall any point.game Parties be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if any point.game Parties have been advised of the possibility of such damages) arising out of or in connection with (a) our Platform or this Agreement or the inability to use our Platform (however arising, including our negligence), (b) statements or conduct of or transactions with any member or third party on the Platform, (c) your use of our Platform or transportation to or from point.game events, attendance at point.game events, participation in or exclusion from point.game camps or events and the actions of you or others at point.game events, or (d) any other matter relating to the Platform. Our liability to you or any third parties in any circumstance is limited to the greater of $100 or the amount of fees, if any, you paid to us in the 12 months prior to the action that may give rise to liability. The limitations set forth above in this Section 8 will not limit or exclude liability for our gross negligence, fraud, or intentional, malicious, or reckless misconduct. Some laws do not allow the limitation or exclusion of liability, so these limits may not apply to you. If you are a member based in the EU, you have legal remedies if we cause you loss by our breach or non-performance of our legal obligations, or by our negligence, and these terms do not affect those statutory remedies.
